2019 Kettle Car Contest Official Rules

No Purchase Necessary. 

 

1. ELIGIBILITY.

Contest (“Contest”) is offered only in the United States to legal residents who are sixteen (16) years old or older.  Photo identification may be asked for proof of age at the discretion of the Team.  Employees, directors, officers, agents and affiliates of High Point Baseball, INC, (“Team”) Vann York Auto Group (“Sponsor”) Old Dominion Freight Line, the Salvation Army, Fox8 and BB&T and all of their respective parents, affiliated and subsidiary companies and the immediate family (spouse, mother, father, sister, brother, daughter or son, regardless of where they live) or members of their same households (whether related or not) of such employees, officers, agents, affiliates and directors are not eligible. 

 

2. AGREEMENT WITH RULES.

By entering BB&T Point 301 N. Elm Street, High Point NC 27262 (“Ballpark”), you agree to be bound by these Official Rules (“Official Rules”) and the decisions of Team and Sponsor, which are final and binding in all respects. 

 

3. PROMOTIONAL PERIOD

Promotional period begins Thursday, July 25th, 2019 at 6:30PM (EST), and ends on Thursday, July 25th, 2019 at either 11:59PM (EST) or the completion of the Sugar Land Skeeters at High Point Rockers Atlantic League baseball game, whichever comes first  ("Promotional Period").  During the Promotional Period, the winner must be present at the Ballpark to win.  Winner will be drawn via a raffle ticket. One (1) raffle ticket will be given per fan over sixteen (16) years or older and they will be distributed as fans enter the Ballpark.  Winner will be chosen if a home run is hit over the centerfield wall and lands, as well as, remains inside a Salvation Army Kettle. The kettle is cast iron/steel and is 40 inches high. The baseball must travel from the batter’s box, over the centerfield wall and into an opening that is 31 inches and the depth of the kettle is 25 inches. The baseball has to remain in the kettle for a lucky winner to be drawn. If the ball either hits the kettle or lands inside of the kettle and bounces out, then one lucky winner will receive a one-year lease for the car that would have otherwise been given away.   The contest will end if one or the other of the two winner scenarios takes place.  Promotion will only occur while a High Point Rockers batter is batting at the bottom of each inning of the Thursday, July 25th 2019 home game against the Sugar Land Skeeters. 

 

4. ENTRY. 

There is only one way to enter and that is by being present at the Thursday, July 25th, 2019 at 6:30PM (EST), Sugar Land Skeeters at High Point Rockers Atlantic League baseball game at the Ballpark.  Team and Sponsor shall not be responsible for lost raffle tickets nor will replacement tickets be issued.  


 

5. PRIZE AND ODDS

Winner would receive a 2019 GMC Arcadia SLE2 automobile provided by Vann York Chevrolet in High Point. The MSRP is $40,060.00, Invoice is $38,640.03 and the cost is $37,889.11. The winner will be responsible for tax, tag & title of the vehicle.  Odds of winning are one (1) in however many eligible raffle tickets are distributed during the Promotional Period. During the Promotional Period, there is a limit of one (1) raffle ticket per legitimate fan. 

 

6. DRAWING.

Drawing will take place under the supervision of Team and Sponsor. The winner will be drawn from all eligible raffle tickets. The winner has ten (10) minutes to identify themselves from within the Ballpark or another winning ticket will be drawn. The winning raffle number will be announced over the public address system and shown on the left field Jumbotron. No assignment, transfer or substitution of a prize is permitted and prize cannot be redeemed for cash, but Sponsor reserves the right to substitute prize with one of equal or greater value should prize become unavailable. Proof of performance via a video of home-run landing or hitting, but not remaining in the kettle, will need to be submitted and verified by Tokio Marine HCC insurance company and at that time the vehicle will be released to the winner. 

 

7. NOTIFICATION OF WINNER; PUBLICITY.

Winner will be identified on July 25th, 2019 if prize is awarded.  Prize winner agrees to grant to Team and Sponsor, its licensees, affiliates and assigns (and to confirm that grant in writing if requested to do so), the right to print, publish, broadcast and use, worldwide in any media now known or hereafter developed, including but not limited to the Internet, at any time or times, the prize recipients’ names, portraits, pictures, voices, likeness and biographical information as news or information and for advertising, trade and promotional purposes without additional consideration or compensation whatsoever, and without prize recipients review, notification or approval.  Winner understands and agrees that they may be asked to execute an affidavit of eligibility and/or liability and publicity waiver-release prior to receipt of their prize.

 

8. WAIVER AND RELEASE. 

By entry into this contest, all entrants agree to:

a. release and hold harmless Team and Sponsor and their respective officers, directors, employees and agents from and against any claim or cause of action arising out of participation in this contest, use of any information submitted by entrant, or receipt or use of any prize; b. consent to the use by Team and Sponsor and its affiliates for advertising, trade or promotional purposes any information submitted hereunder, including without limitation communication with entrant regarding this contest; and c. waive any and all rights; this waiver shall include specifically any right to receive any consideration whatsoever for any such information so submitted.

 

9. ARBITRATION; CHOICE OF LAW. 

Except where prohibited, entrants agree that: 

(a) any and all disputes, claims, and causes of action arising out of or connected with 

this contest shall be resolved individually, without resort to any form of  class action, and exclusively by arbitration pursuant to the Rules of the America Arbitration Association; (b) any and all claims, judgments and awards shall be limited to actual out – of - pocket costs incurred, including costs associated with entering this contest but in no event attorney’s fees; and (c) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Moreover, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Team and Sponsor in connection with the contest, shall be governed by, and construed in accordance with, the laws of the State of North Carolina, without regard for conflicts of law principles, and all proceedings shall take place in that State.

 

10. GENERAL CONDITIONS. 

Team and Sponsor reserve the right to cancel, suspend and/or modify any part of the contest if any fraud, virus or other technical problem corrupts the administration, security, or proper execution of the contest, as determined by Team and Sponsor in its sole discretion. In such event, Team and Sponsor reserve the right to award the prize in accordance with the selection processes described above. Team and Sponsor reserve the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the contest may be a violation of criminal and civil law, and, should such an attempt be made, Team and Sponsor reserve the right to seek damages from any such person to the fullest extent permitted by law. Team and or Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. 

 

11. WINNERS LIST. 

Upon the conclusion of the Contest, the winner’s name will be available at High Point Baseball, INC 301 N. Elm Street, High Point, NC 27262.  A copy of these Official Rules and the name of the winner will be posted online at highpointrockers.com.
